TERMS OF SALE

The owner of the online store www.nofikids.com (hereinafter referred to as the Webstore) is Nofi Kids OÜ (registry code 16151787), located at Ringtee tn 25, 50105 Tartu Estonia.

Validity of the Sales Agreement, Product and Price Information
These Terms of Sale apply when purchasing goods from the Webstore.
The prices of products sold in the Webstore are listed next to the products. All prices in the Webstore are in euros.
Product information is provided directly with the product in the Webstore.

Placing an Order
To place an order, the desired products must be added to the shopping cart. To complete the order, the required fields must be filled out and a suitable delivery method must be selected. The total amount will then be displayed and payment can be made securely via the following payment methods:

  • Estonian bank links: Swedbank, SEB, Luminor, LHV, Coop Bank
  • Card payment.

Payments are processed by Montonio Finance OÜ. Payment takes place in a secure environment outside the Webstore – when paying via bank link, it happens in the respective bank’s secure environment. The Webstore does not have access to the customer’s bank details. The contract becomes valid once the payment has been received in the Webstore’s account.
The Webstore owner is the data controller and forwards the necessary personal data to the authorized processor Montonio Finance OÜ for payment processing.
If the ordered goods cannot be delivered due to the product being out of stock or any other reason, the customer will be informed as soon as possible, and the paid amount will be refunded without delay, but no later than within 14 days from the notification.

Delivery
Goods are shipped to the following countries: Estonia, Finland, Latvia, Lithuania.
To receive the goods, the customer has the following options: Omniva and DPD parcel machine service.
For domestic purchases in Estonia, no delivery fee is added to the price of the product.
Domestic shipments usually reach the customer’s designated destination within 5 business days after the sales contract has been concluded.

Right of Withdrawal
After receiving the order, the customer has the right to withdraw from the contract within 14 days.
The right of withdrawal does not apply if the buyer is a legal entity.
To use the 14-day return right, the product must not have been used in any way other than necessary to check its nature, characteristics, and functionality, as is permitted for testing the product in a physical store.
Returned products must be unopened in their original packaging, along with instructions and other documentation.
If the product has been used for purposes other than checking its nature, characteristics and functionality or shows signs of use or wear, the Webstore has the right to reduce the refund in accordance with the product’s diminished value.

If the buyer has chosen a different delivery method than the most economical one offered by the seller, the seller is not obligated to reimburse the cost that exceeds the normal delivery cost.
To return a product, the buyer must send information by email to info@nofikids.ee within 14 days of receiving the goods.
The buyer bears the return shipping costs unless the reason for the return is that the returned product does not correspond to what was ordered (e.g., wrong or defective product).
The buyer must return the product within 14 days of submitting the withdrawal statement or provide evidence that the product has been handed over to the carrier during this period.
Upon receiving the returned product, the Webstore will refund all payments made by the customer under the contract without delay, but no later than 14 days after receiving the withdrawal statement.
The Webstore may refuse to issue a refund until it has received the returned product or the buyer has provided evidence that the product has been returned, whichever occurs first.
The Webstore has the right to cancel the sales transaction and reclaim the product from the buyer if the product price in the Webstore was mistakenly listed significantly lower than its market price due to an error.
The Webstore has the right to cancel the sales transaction partially or entirely if the ordered product has been sold out or turned out to be defective. In this case, the seller will contact the customer within 2 business days via email or phone and inform the customer about the issue.
The refund will be credited to the customer’s specified bank account in full or, according to an agreement with the customer (replacement product, partial refund, etc.).

Right to File a Complaint
The Webstore is responsible for the conformity of the goods sold to the customer and for any defects present at the time of delivery, which become apparent within two years from the delivery of the goods to the customer. Within the first six months of delivery, it is presumed that the defect existed at the time of delivery.

The Webstore is responsible for refuting this presumption.
The buyer has the right to file a complaint regarding any defects within two months of their appearance by sending an email to info@nofikids.ee or calling +372 5355 5649.
The Webstore is not responsible for defects arising after the product has been delivered to the customer.
If the goods purchased from the Webstore are defective and the Webstore is responsible for the defect, the Webstore will repair or replace the defective product. If the product cannot be repaired or replaced, the Webstore will refund all payments made under the sales contract.
The Webstore will respond to the consumer’s complaint in writing or in a form that allows written reproduction within 15 days.

Direct Marketing and Personal Data Processing
The Webstore uses the customer’s personal data (e.g., name, phone number, address, email address, bank details) only for processing the order and delivering the goods to the customer.
The Webstore may forward personal data to the transportation service providers to deliver the goods.
The Webstore will send newsletters and offers to the customer’s email address only if the customer has expressed interest by entering their email address on the website and indicating their desire to receive direct marketing messages.
The customer can opt-out of receiving emails at any time by notifying the Webstore via email or following the instructions in the promotional emails.

Dispute Resolution
If the customer has any complaints regarding the Webstore, they must be sent to info@nofikids.ee or by calling +372 5355 5649.
If the customer and the Webstore cannot resolve the dispute by agreement, the customer can contact the Consumer Disputes Committee. The committee is authorized to resolve disputes arising from the contract between the buyer and the Webstore. The review of the complaint by the committee is free of charge.

The Webstore has the right to change and update these Terms and Conditions and the price list due to the development of the online store and to ensure better and safer use of the store.
